2. Nature of the Platform

CDLers is a business-to-business recruitment technology platform that:

• Collects Commercial Driver profiles
• Filters and qualifies applications
• Confirms consent and availability to be contacted
• Makes driver profiles available to registered companies
• Allows companies to unlock driver contact information using credits

CDLers is not:

• A motor carrier
• A broker of freight
• An employer of drivers
• A staffing agency

CDLers does not guarantee hiring outcomes, driver performance, or employment results.

3. Eligibility

The Platform is intended for:

• Lawfully registered motor carriers
• Authorized representatives of transportation companies
• Recruiting professionals acting on behalf of carriers

You represent and warrant that:

• You have authority to bind your company
• All information provided is accurate
• You will use the Platform only for lawful recruitment purposes

4. Account Registration

To access driver profiles, you must create an account.

You agree to:

• Provide accurate information
• Maintain account confidentiality
• Immediately notify us of unauthorized access

CDLers reserves the right to suspend or terminate accounts for violations of these Terms.

5. Credit System & Payments

Driver contact details are accessible via a credit-based unlock system.

5.1 Credit Purchases

• Credits must be purchased in advance.
• Bonus credits may apply based on purchase volume.
• Credits are non-transferable.

5.2 Unlocking Profiles

When you unlock a profile:

• The required credit amount is deducted immediately.
• Access to driver contact details is granted.

5.3 No Guarantee of Hire

Unlocking a profile does not guarantee:

• Driver response
• Hiring
• Employment duration
• Driver performance

Recruitment outcomes depend on your internal processes.

5.4 Refund Policy

All credit purchases are final and non-refundable unless required by law.

CDLers may review refund requests solely at its discretion in cases of:

• Technical system errors
• Duplicate charges

6. Acceptable Use

You agree NOT to:

• Scrape, copy, export, or resell driver data
• Share unlocked driver data with third parties
• Use automated extraction tools
• Harass or misuse driver contact information
• Contact drivers outside recruitment purposes
• Circumvent the credit system

Violation may result in:

• Immediate suspension of account
• Forfeiture of unused credits
• Legal action, if applicable

7. Driver Data & Compliance

Drivers provide information voluntarily and consent to being contacted by recruiting companies.

Companies using CDLers agree to:

• Comply with all applicable U.S. federal and state laws
• Comply with TCPA and communication consent laws
• Respect opt-out requests
• Maintain data confidentiality

You are solely responsible for how you use driver contact information after unlocking.

8. Limitation of Liability

To the maximum extent permitted by law:

CDLers shall not be liable for:

• Hiring losses
• Driver misconduct
• Business interruption
• Lost profits
• Indirect or consequential damages

Total liability shall not exceed the amount paid by the user within the previous 30 days.

9. Indemnification

You agree to indemnify and hold CDLers harmless from any claims arising from:

• Your misuse of driver data
• Your hiring practices
• Violation of recruitment laws
• Communication compliance failures

10. Intellectual Property

All platform content including:

• Branding
• Logos
• Software
• Filtering systems
• Credit system logic

is the exclusive property of CDLers.

Unauthorized reproduction is strictly prohibited.

11. Termination

We may suspend or terminate accounts for:

• Fraudulent activity
• Chargebacks
• Data misuse
• Terms violations

Unused credits may be forfeited upon termination due to violation.

12. Data Usage Restriction

Driver data obtained through CDLers:

Unauthorized sharing constitutes material breach.

• May be used solely for internal recruitment purposes
• May not be resold, redistributed, sublicensed, or shared
• May not be added to third-party databases
